What kind of court is the Fountain Hills Municipal Court?

The Fountain Hills Municipal Court is the judicial branch of Fountain Hills government. The Court has jurisdiction over civil traffic, criminal traffic and criminal misdemeanor offenses, as well as violations of the Town Code and ordinances. The Court also has authority over specified juvenile offenses. The Judge has authority to issue arrest/search warrants and the authority to issue orders of protection (domestic violence) and injunctions against harassment.

Can I file a lawsuit or a small claims action at the Fountain Hills Municipal Court?

No. If you have any questions regarding a lawsuit, contact the Maricopa County Superior Court at (602) 506-3360. For small claims questions, contact the Maricopa County Justice Court information at (602) 506-8530.

When can I see the Judge?

Due to the regularly scheduled Court business, contact the Court beforehand for the Judge's availability. Please note that it is not always necessary to see the Judge and many questions can be answered by the Court staff, however they cannot provide legal advice, only general information as it relates to the case.

Where is the court located?

16705 East Avenue of the Fountains, which is in the Fountain Hills Town Hall at the intersection of La Montana and Avenue of the Fountains, approximately three blocks East of Saguaro Boulevard? Office hours are Monday through Thursday, 7 a.m. to 6 p.m.

Can I file for divorce at the Fountain Hills Municipal Court?

No. If you have any questions regarding a divorce, contact Maricopa County Superior Court at (602) 506-3360.

Can you tell me if my driver license has been suspended?

If you want to know about your MVD record, you must contact the MVD at (602) 255-0072.

What is an abstract?

An abstract is the paperwork the court provides to the MVD that lifts the request to suspend the driver license. An abstract is produced when all fines/fees are paid in full. Abstracts are valid only from the specific court that requested the suspension to be placed on the driver license. Fountain Hills Municipal Court can only issue an abstract on cases filed in Fountain Hills Municipal Court. You may obtain an abstract from the court to take to the MVD for immediate clearance or the court will send an abstract to MVD through the normal course of business.

Is there information available regarding my fines, fees and restitution and making payments?

Yes. Once you have made a plea or have been found guilty or responsible of a violation, you have an obligation to pay your fines on the date of sentencing. When you plead "Guilty" or "No Contest" to criminal violations or "Responsible" to civil violations, you must make full payment for all fines/sanctions owed.

Note: All fines, sanctions, fees and restitution are due in full on the day of sentencing. To calculate the total amount due on a civil citation, refer to the Fine/Fee Schedule on the bond card given to you by the officer at the time your citation was issued. If you did not receive a bond card, refer to the Fine/Fee Schedule in the Resources. Add the fine for each violation on the citation. If you are not sure of the violation charged or the fine due, you will have to come to the Court or contact the Court at 480-816-5103. To allow for data entry, please wait at least one week after the violation date before calling the Court.

How do I make a payment?

We will accept payments by cash, check, money order, Visa or Master Card?Mail your payment to the Fountain Hills Municipal Court: 16705 East Avenue of the Fountains, Fountain Hills, Arizona 85268. Make your check or money order payable to the Fountain Hills Municipal Court in the full amount due and include the complaint number?Provide your current address if it is different from the address on the check.

Payment by Visa or Master Card: You may pay by credit card by phone at (480) 816-5103 during normal business hours.

Partial Payments: If you are financially unable to meet your court ordered obligation on the day of sentencing, you may be placed on a payment plan. This can only be considered after you have completed a detailed sworn financial affidavit to determine your ability to pay. Credit history verification through a national credit bureau may also be required. This process may take up to one hour or longer. A $20 State-mandated time payment fee will be added to your total obligation and you may also be required to make a substantial down payment.

What happens if I do not pay in full or do not comply with the payment plan?

If you do not pay in fullĀ or comply with your payment plan, the Court will:

  • Order you to appear in Court to explain your failure to comply with the Court's order to pay or issue a warrant for your arrest (for criminal and criminal traffic cases only).
  • Add a $25 default fee to the amount you owe for each civil traffic violation on your case.
  • Notify the MVD of the failure to pay. The MVD will suspend your driving privilege. Note: Driving on a suspended license/privilege is a criminal traffic charge that could result in arrest.
  • Refer your case to a collection agency, which will add additional fees and may result in a hold being placed on your vehicle registration, preventing you from renewing it.
  • Notify a credit-reporting bureau of your delinquent balance.
  • Take other legally appropriate collection action against you, your income or your property, including notifying the Arizona Department of Revenue to attach your tax refund.

What if I am unable to make my scheduled payment?

If you are unable to make your scheduled payment, you must appear at the Court no later than 4 p.m. on your payment due date to request a financial review for a possible extension. You may be required to complete a new financial application and undergo the financial review process. You must appear in person to request an extension on your payment arrangements. The court requires all defendants to appear in court and sign all applicable documents.

I have a warrant for my arrest for failure to pay. Can I have my payment arrangement reset and have the warrant cancelled?

You must pay in full or appear before a Judge before the warrant is cancelled (quashed).

I had my license suspended for failure to pay. Can I have my payment arrangement reset to have my license reinstated?

You must pay in full or appear before a Judge to receive a clearance for your driver license suspension.

Can someone drop off my payment for me?

Anyone can drop off your payment for you. The payment must be received before 6 p.m. on the specified due date.
